01. BINDING GOVERNANCE
Operational
Acceptance.
Accessing Trackomatic India platforms constitutes an irrevocable agreement to adhere to our engineering and legal standards.
Accessing our proprietary engineering data, RDSO-aligned schematics, or corporate profiles signifies your agreement to be bound by these protocols. These terms govern all interactions between Trackomatic India (TIPL) and the user, superseding any prior informal communications.
Technical Sovereignty & Liability
Establishing the boundaries of professional responsibility and intellectual protection.
02. IP Sovereignty
All machinery designs, OHE technical data, and CAD visualizations are the exclusive property of TIPL. Modification, reverse-engineering, or commercial "scraping" of these materials is strictly actionable under IP law.
03. Technical Errata
While we strive for RDSO-standard precision, digital materials are for "informational use only." TIPL is not liable for field errors resulting from reliance on unverified digital specifications or out-dated catalog entries.
04. Indemnity
Users agree to indemnify and hold harmless Trackomatic India against all losses, damages, and costs arising from the unauthorized use of equipment or breach of these site protocols.
05. Force Majeure & Operational Delays
Trackomatic India shall not be held liable for any failure or delay in performance (including delivery and site support) resulting from causes beyond its reasonable control. This includes, but is not limited to: Acts of God, industrial disputes, supply chain disruptions in railway-grade raw materials, or shifts in RDSO/Government of India regulatory mandates.
Legal Jurisdiction
06. Governing Law
Any dispute, controversy, or claim arising out of these terms shall be governed by and construed in accordance with the laws of India. All legal proceedings shall be subject to the exclusive jurisdiction of the courts in Sonipat, Haryana.
